Terms of Use

These Terms of Use (the “Terms”) govern access to and use of yappix.net and related services (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service description and our role as an aggregator

1.1. The Service provides access to interfaces and integrations with popular third-party artificial intelligence models and tools (including LLMs and image models).
1.2. We operate as an aggregator that facilitates access, routing, and billing. We are not the developer of those third-party models and do not control their performance or outputs.
1.3. All generated results are produced by algorithms and third-party providers, not by us.

2. Accounts and access

2.1. You must provide accurate account and payment information and keep credentials secure.
2.2. We may suspend or terminate access for violations of these Terms, abusive conduct, or risk to the Service.

3. User content, outputs, and your responsibility

3.1. You are solely responsible for prompts, inputs, datasets, and any resulting outputs, including text, images, code, or other materials (collectively, “Content”).
3.2. Output disclaimer. We do not assume responsibility for any Content generated through the Service, including its accuracy, legality, completeness, suitability, or fitness for your purposes.
3.3. Further use and distribution. We are not responsible for any subsequent use, publication, distribution, modification, or other handling of Content by you or any third party.
3.4. You must not use the Service for unlawful activity, to infringe rights, or to distribute prohibited materials. You represent that you have the necessary rights to any materials you upload or input and grant us a non-exclusive license to process them as needed to operate the Service.

4. AI models and quality of results

4.1. AI models are probabilistic and may produce errors, hallucinations, outdated, biased, or offensive outputs.
4.2. No quality guarantee. We do not guarantee the accuracy, reliability, availability, safety, or suitability of outputs for any purpose.
4.3. Third-party technology. The quality and functionality of LLMs and other models are determined by their respective owners/providers. We are not responsible for defects, outages, delays, API changes, limitations, or any issues attributable to third-party models.

5. Pricing, billing, and changes without prior notice

5.1. Prices, tariffs, limits, and billing units (e.g., tokens/requests/minutes) are shown in the Service interface or invoice.
5.2. Right to change prices. We may change prices, tariffs, limits, and commercial terms at any time without prior notice. New terms apply upon posting in the Service or when reflected in your account/invoice.
5.3. Applicable taxes, payment processor fees, and currency conversion costs are your responsibility unless stated otherwise.
5.4. Refunds, if any, are at our discretion and limited to unused portions of services unless otherwise required by law.

6. Acceptable use restrictions

Prohibited uses include:
a) violating applicable law;
b) creating or distributing malware, spam, or phishing;
c) infringing intellectual property, privacy, or publicity rights;
d) circumventing technical limits or attempting reverse engineering of models;
e) uploading/inputting unlawful materials;
f) deploying outputs in high-risk contexts without independent verification (e.g., medical, legal, financial, safety-critical, or other regulated uses).

7. Intellectual property

7.1. Rights in the Service, interfaces, databases, and branding belong to us or our licensors.
7.2. Rights in third-party AI models and their outputs belong to the respective rightsholders to the extent allowed by their licenses.
7.3. We grant you a limited, revocable, non-exclusive license to access and use the Service per these Terms.

8. Privacy

Personal data is processed under our Privacy Policy available on the Site. By using the Service, you accept that policy.

9. Disclaimers

The Service is provided “as is” and “as available.” We and our suppliers disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

10. Limitation of liability

10.1. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, punitive, special, or consequential damages; loss of profits; loss of data; business interruption; cost of substitute services; or damages arising from use of or inability to use the Service or Content.
10.2. In all cases, our aggregate liability for all claims is limited to the greater of: (i) the amounts you actually paid for the Service in the 3 months preceding the event giving rise to liability, or (ii) USD 100 if no amounts were paid.
10.3. These limits apply regardless of legal theory and even if we were advised of the possibility of such damages.

11. Indemnification

You will indemnify and hold us and our affiliates harmless from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your Content, your violation of these Terms, or your violation of third-party rights.

12. Service changes and downtime

12.1. We may modify, suspend, or discontinue any part of the Service at any time.
12.2. We are not responsible for outages, delays, or access issues caused by third-party providers, networks, payment systems, AI model providers, or force majeure.

13. Third-party links and services

The Service may contain links to or integrations with third-party sites or services. We do not control them and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.

14. Governing law and dispute resolution

14.1. For residents of the Russian Federation: These Terms are governed by the laws of the Russian Federation; disputes are subject to the competent courts at the place of registration of the RF controller (Usmanov Renat Rushanovich), unless mandatory law provides otherwise.
14.2. For residents outside the Russian Federation: These Terms are governed by the laws of the jurisdiction of registration of YappiX LLC, and disputes are subject to the competent courts of that jurisdiction.
14.3. Mandatory arbitration or mediation may apply where required by local law or a separate agreement.

15. Changes to these Terms

We may update these Terms at any time. Changes take effect upon posting in the Service or as otherwise stated. Your continued use after changes constitutes acceptance.

16. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms. Sections concerning privacy, IP, disclaimers, limitations of liability, governing law, and indemnification survive termination.
